Draft Waiver Amendments

Notice of Proposed Amendments to Waivers

The Division of Senior and Disabilities Services (SDS) is requesting comment from recipients, waiver service providers, and other stakeholders on amendments to four of Alaska’s 1915(c) home and community-based services waivers.

The amended waivers are:

  1. People with Intellectual and Developmental Disabilities (IDD)
  2. Adults with Physical and Developmental Disabilities (APDD)
  3. Children with Complex Medical Conditions (CCMC)
  4. Individualized Supports Waiver

The proposed amendments to all four waivers allow limited amounts of Day Habilitation services to be provided in a residential setting, if approved in a recipient’s support plan. Additionally, the proposed amendments to the ISW include changing the process for selection of entrants to the waiver, and updating the language describing the Level of Care determination process to align with current practice, and updating the Employment Services service definition to align with current regulation.

The proposed waiver amendments can be viewed on the SDS HCBS Waivers webpage. Due to COVID precautions, copies of the proposed waiver amendments are not available for viewing at SDS offices.

SDS will hold a webinar to explain the waiver amendments on Wednesday, January 5th at noon. Information about signing up for the webinar can be viewed on the SDS HCBS Waivers webpage.

SDS will accept public comment on the proposed waiver amendments until 5:00 pm, Friday, January 25, 2022. Please send written comments to Jetta Whittaker, PO Box 110680, Juneau AK 99811, or jetta.whittaker@alaska.gov. Once the comments have been reviewed and necessary changes incorporated into the proposed waivers, the waivers will be submitted to the Centers for Medicare and Medicaid (CMS) to become effective on July 1, 2022.
